LA CASANO
GENERAL TERMS AND CONDITIONS OF SALE B2C
1. Presentation
These general terms and conditions of sale (the “GTC”) apply to any purchase of items (the “Items”) made at a permanent or temporary physical retail location of La Casano (the “Boutique”) and on the website lacasano.com (the “Site”) by any natural person acting outside the scope of their professional activity (the “Customer”).
The Site is published and managed by La Casano, a simplified joint-stock company with a share capital of 500 euros, registered under number 920 191 624 RCS Paris, with its registered office located at 51 rue Marguerite de Rochechouart à Paris (75009), France, represented by its President, domiciled in this capacity at the aforementioned address (“La Casano”).
The Customer acknowledges having read and unconditionally accepted the GTC in their entirety with each order and by checking the designated box on the Site when making an online purchase. La Casano reserves the right to modify these GTC at any time. Such modifications become enforceable upon their publication on the Site or their availability in the Boutique.
2. Purchase on the Site
2.1 Order Process on the Site
To purchase an Item on the Site, the Customer must add the Item to their virtual cart and then click on "Confirm my order." Delivery times are indicated during order confirmation. The Customer provides their contact details, delivery address, and payment method.
The Customer has the opportunity to review the details of their order and the total price before finalizing the purchase.
An email acknowledging receipt of the order and payment is sent to the Customer.
2.2 Right of Withdrawal
For any purchase made on the Site, the Customer may exercise their right of withdrawal within fourteen (14) calendar days from the date of receipt of the Item, in accordance with Article L. 221-18 of the French Consumer Code.
To exercise this right, the Customer must contact customer service at contact@lacasano.com within the aforementioned timeframe and inform them of their decision by sending either the withdrawal form attached as an annex to the GTC or an unambiguous declaration expressing their intention to withdraw.
If the right of withdrawal is exercised in compliance with the applicable conditions, La Casano will reimburse the Customer for all amounts paid within a maximum period of fourteen (14) calendar days from the date of receipt of the Item by La Casano. The refund will be issued via a credit to the same payment card used for the purchase, excluding return shipping costs.
The Customer cannot exercise the right of withdrawal for Items made to their specifications or personalized, in accordance with Article L. 221-28, 3° of the French Consumer Code.
3. Warranties
The Customer benefits from the legal warranty of conformity provided by Articles L.217-3 and following of the French Consumer Code, as well as the legal warranty against hidden defects provided by Articles 1641 and following of the French Civil Code. The Customer may exercise these warranties by sending their request to: La Casano, 51 rue Marguerite de Rochechouart – 75009 Paris or contact@lacasano.com.
The consumer has a period of two years from the delivery of the goods to request the implementation of the legal warranty of conformity in case of a defect of conformity. During this period, the consumer is only required to establish the existence of the defect of conformity, not the date of its appearance.
When the sales contract for the goods includes the provision of digital content or a digital service on a continuous basis for a period of more than two years, the legal warranty applies to this digital content or service throughout the entire provision period. During this period, the consumer is only required to establish the existence of the defect of conformity affecting the digital content or service, not the date of its appearance.
The legal warranty of conformity requires the professional, where applicable, to provide all necessary updates to maintain the conformity of the goods.
The legal warranty of conformity entitles the consumer to repair or replacement of the goods within thirty daysfrom the request, at no cost and with no major inconvenience to the consumer.
If the goods are repaired under the legal warranty of conformity, the consumer benefits from an extension of six months to the original warranty period.
If the consumer requests repair of the goods, but the seller imposes replacement, the legal warranty of conformity is renewed for a period of two years from the date of replacement of the goods.
The consumer may request a reduction in the purchase price while keeping the goods or may terminate the contract and receive a full refund upon returning the goods if:
1. The professional refuses to repair or replace the goods;
2. The repair or replacement takes more than thirty days;
3. The repair or replacement causes significant inconvenience for the consumer, especially when the consumer bears the cost of returning or removing the non-compliant goods, or the cost of installing the repaired or replaced goods;
4. The non-conformity of the goods persists despite the seller's attempt to remedy the issue.
The consumer is also entitled to a price reduction or contract termination when the defect is so serious that immediate reduction or termination is justified. In such cases, the consumer is not required to first request repair or replacement of the goods.
The consumer does not have the right to terminate the sale if the defect is minor.
Any period during which the goods are immobilized for repair or replacement suspends the warranty until the goods are delivered in restored condition.
The rights mentioned above are based on the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.
The seller who delays in bad faith the implementation of the legal warranty of conformity may face a civil fineof up to €300,000, which may be increased to 10% of the average annual turnover (Article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal warranty against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This warranty entitles the consumer to a price reduction if the goods are kept or a full refund upon returning the goods.
4. Intellectual Property
The elements reproduced on the Site are the exclusive property of La Casano and are protected by intellectual property rights, including copyright, trademark rights, and design rights. Any reproduction or representation of these elements, without the prior and express authorization of La Casano, is prohibited and may result in legal action against offenders.
5. Personal Data
The processing of the Customer's personal data is detailed in La Casano's Privacy Policy.
6. Applicable Law
These GTC are subject to French law.
7. Consumer Mediator
In case of a dispute and prior to any recourse to the consumer mediator, the Customer must contact La Casano by email at the following address: contact@lacasano.com to attempt to amicably resolve the dispute between the Customer and La Casano.
If the dispute is not resolved amicably within two months from the written complaint referred to in the previous paragraph of this article, the Customer may resort to free consumer mediation under the conditions set out in Articles L.612-1 and following of the French Consumer Code. The mediator must be contacted within a maximum of one year from the initial complaint.
